Unlawful Prosecution, Search, Detention, Damage, Kidnapping and Violation of Diplomatic Immunity

We the People, represented by John Smith, respectfully submit this information to address the unlawful actions taken by Police Scotland and other statutory authorities during events on Monday, 10 February 2025, which involve serious violations of both domestic and international law.

1.  Background of Incident:

On 10 February 2025, Police Scotland, consisting of approximately twenty-four (24) officers, attended two premises:

  • CLC Embassy, Cruinn House, 1 Wurzburg Court, Dundee, DD2 1FB
  • Diplomats Home Address

These premises were entered by the officers under the belief they possessed a lawful search warrant. However, no copy of the warrant was given to me at the time of the search, and I was not provided an opportunity to inspect it at that time as my concern was for my partner who is disabled and has a serious lung condition and a life-threatening condition. Upon later request at the police station, I was refused a copy of all paperwork and the recorded interview that I gave.

2.  Unlawful Conduct:

  • The police officers forcibly entered both premises without providing sufficient legal documentation or proof of an alleged warrant.
  • The authorities involved, unlawfully detained and prosecuted the accused, a living man and a CLC Diplomat who was not the intended target of the search or prosecution. The named individual was a legal person, but I was unlawfully arrested and treated as the wrong person for prosecution.
  • There was a mistaken identity regarding the accused as even his date of birth confirmed this.
  • The police officers engaged in threatening behaviour, and I believe that I was unlawfully detained in a manner that constitutes kidnapping.

3.  Creation of the Common Law Court Diplomats and the CLC Embassy:

On 17 October 2021, during a lawfully convened Common Law Court, a jury of twelve reasonably minded living men and women issued a court order to establish a diplomatic service for living men and women, throughout the world. This court order led to the creation of CLC Diplomats and the CLC Embassy, which operates to engage with statutory authorities in matters concerning the lawful rights and protections of living men and living women.

Since its creation, the CLC Diplomats and CLC Embassy have engaged with numerous statutory authorities worldwide. The willingness of these authorities to correspond and engage with us at the CLC Embassy has confirmed the recognition, jurisdiction and acceptance of our position, including but not limited to the Scottish Government, Scottish Courts and Tribunals Service, and HMCTS (Her Majesty’s Courts and Tribunals Service). Notably, both the Scottish Courts and Tribunals Service and HMCTS have recently accepted the Common Law Court Diplomatic Passport as a valid document that complies with their legal legislative requirements.

4.  Violations of Diplomatic Immunity and International Law:

In addition to the unlawful actions outlined above, the conduct of Police Scotland constitutes a violation of international law, specifically the Vienna Convention on Diplomatic Relations (1961), which the United Kingdom is a party to. Relevant articles of the Convention and the Diplomatic Privileges Act 1964 must be considered:

Vienna Convention on Diplomatic Relations (1961)

  • Article 22 of the Vienna Convention states that the premises of an embassy are inviolable, and the host state is responsible for protecting them from intrusion or The actions of Police Scotland on 10 February 2025, who unlawfully entered the CLC Embassy, caused damage to property, stole private property, and opened sealed mail, directly violate these protections.
  • Article 29 of the Vienna Convention provides that diplomats enjoy personal immunity from arrest or detention and freedom from local jurisdiction, except under certain I, as a CLC Diplomat, was unlawfully detained and prosecuted without the proper application of these protections.
  • Article 30 further protects the diplomat’s private residence from intrusion or damage by the authorities of the host country. The actions of Police Scotland, entering my premises and damaging property, are in direct contravention of this protection.

Diplomatic Privileges Act 1964

  • This act enforces these protections within the United Kingdom, which means that these unlawful acts by Scottish Police are in direct violation of both international law and the domestic legal framework.

5.  Requests for Immediate Actions:

Given the severe violations of diplomatic immunity and protections under both international and domestic law, I request the following actions:

  1. Full Explanation of Unlawful Entry – A detailed explanation of the circumstances surrounding the unlawful entry by Police Scotland into the CLC Embassy premises, including the authority, jurisdiction and justification for entering without providing the necessary search
  2. Damage Assessment and Rectification – A full, detailed account of the damage caused during the unlawful entry, including an assessment of the extent of the damage and the steps being taken to repair and rectify the situation. Additionally, I request that compensation be provided for the damage caused in accordance with international norms, as stipulated by the Vienna Convention.
  3. Prevention of Future Violations – Immediate steps to ensure that such unlawful actions do not occur again, including measures to guarantee the inviolability of Embassy premises and that the personal immunity of diplomats are respected and upheld by Police Scotland and other statutory authorities.
  4. Return of Stolen Property – The immediate return of all property, unlawfully taken from the CLC Embassy, including but not limited to, documents, equipment, and personal property.
  5. Compensation – Compensation for the damage caused to Embassy property should be provided in a timely manner, in alignment with international diplomatic standards and the Vienna Convention on Diplomatic Relations.

6.  Further Diplomatic Measures:

Failure to resolve this issue promptly may necessitate further diplomatic measures, including but not limited to a formal protest through the appropriate channels, as well as the involvement of the Scottish Government. I trust that this matter will be treated with the utmost seriousness and urgency.

7.  Request:

In addition to the above, I request immediate action to address the following:

  1. Return of Property – The immediate return of all property unlawfully seized from the two properties listed, during the police search.
  2. Copy of Search Warrant(s) – I require a copy of the alleged search warrant(s) that were purportedly used to justify the entry into the premises, along with any associated
  3. List of Police Officers – Provide a full list of names, badge numbers, and other details of the officers who attended and conducted the search.
  4. Police Interview Records – Provide a copy of the statement, recorded during my police interview, which was not given to me when asked for at the time of the interview.
  5. Video Footage and Evidence – Provide copies of all video footage taken by the attending officers, including their body cameras during the search, as well as any evidence that shows the police damaged the premises, during the course of the search.
  6. Insurance Details – I was informed that the damage caused during the search would be repaired at the cost of Police Scotland. I request a copy of the insurance details for Police Scotland to initiate a claim for the damage caused.

8.  Common Law Court Order:

In relation to the so called extorsion, the money pursued was due to the refusal of the named individuals to comply with a lawfully issued court order. The concerned individuals’ and the authorities’ failure to respect this order constitutes further unlawful actions, such as failure to comply with, hinder or obstruct, which confirms that the parties involved are in contempt of court.

In light of the above, I respectfully request your assistance in this matter to ensure that the appropriate action is taken against the named individuals. The return of unlawfully seized property, and the required copies of all evidence, paperwork and statements in this matter should be forwarded as a matter of urgency.

Please respond within seven (7) days with the necessary information required and an explanation to confirm how this matter will be resolved.

Subject: Urgent Request to Pass Communication to the UK Prime Minister Regarding UK and International Crimes Against the People

 

Dear Secretary of State,

I am writing to you with great urgency to request that you pass on the attached letter and case history to the Prime Minister of the United Kingdom as a matter of national and international importance. The concerns outlined in the attached communication pertain to serious violations of law that affect not only the people of the Scotland but also the United Kingdom, as this also has far-reaching international implications.

Despite previous attempts to engage with the relevant authorities, including but not limited to, Police Scotland, government officials and the judiciary.  I have been met with a lack of response or appropriate action. The matters raised include violations of fundamental human rights, breaches of common law, and acts that contravene both domestic and international legal frameworks.

As the Secretary of State for Scotland, you hold a position of responsibility to ensure that grave concerns affecting the rights, freedoms, and well-being of the people are addressed at the highest level of government. Therefore, I request that you formally acknowledge receipt of this letter and confirm that my communication will be promptly delivered to the Prime Minister for urgent review and necessary action.

I trust in your commitment to upholding justice and ensuring that this pressing matter receives the attention it requires. Please provide me with a response at your earliest convenience, confirming the steps you will take in this regard.

Subject: Continued Failure to Address Unlawful Actions by Police Scotland – Request for Prime Ministerial Intervention

Dear Prime Minister,

We the People, numbering 92,750, stand as living men and living women, having confirmed our standing with the Common Law Court Great Britain & International (CLC). We stand firmly within the Cruinn Community and write to you with urgency to seek your intervention in an ongoing matter involving Police Scotland and the Lord Advocate’s unlawful actions, violations of international law, and the continued failure of relevant authorities to respond to legitimate requests for accountability.

On 25 February 2025, a formal letter was addressed to Chief Constable Jo Farral of Police Scotland, copied to Lord Advocate Dorothy Bain, Cabinet Secretary for Justice Angela Constance, and First Minister John Swinney of the Scottish Government (see attached). The letter detailed serious allegations of an unlawful prosecution, unlawful search and detention, damage to property, kidnapping, and violations of diplomatic immunity under the Vienna Convention on Diplomatic Relations (1961) and the Diplomatic Privileges Act 1964.

Despite a clear request for a response within seven (7) days, no reply has been received from any of the addressed parties. This failure to respond not only demonstrates a lack of accountability but also raises concerns about the adherence of statutory authorities to the rule of law.

  1. Unlawful Actions by Police Scotland – Including but not limited to unauthorized entry, damage to property, and failure to provide legal documentation during an unlawful search on 10 February 2025.
  2. Violation of Diplomatic Immunity – Unlawful detention and prosecution of a CLC Diplomat, in direct contravention of international and domestic diplomatic protections.
  3. Failure to Provide Requested Documentation – Police Scotland has refused to provide search warrants, evidence logs, officer details, interview records, or video and body-worn camera footage.
  4. Refusal to Engage with the CLC Embassy – Despite prior recognition by statutory authorities of the Common Law Court Great Britain & International Diplomatic Service and its passports.
  5. Failure to Respond to the Initial Correspondence – No reply has been received from the Chief Constable of Police Scotland, the Lord Advocate, the Scottish Cabinet Secretary for Justice, or the First Minister.
  6. Ongoing Criminal Investigation Against the Lord Advocate – The Lord Advocate, Dorothy Bain, is currently under criminal investigation by Police Scotland for crimes against the people. This further highlights the absence of a clear separation of powers in Scotland, calling into question the legitimacy of the legal system and the rule of law. The appropriate crime number has already been issued for this case.

Given the gravity of this situation and the continued failure of the responsible parties to address the matter, we formally request your direct intervention to ensure that the following actions are taken:

  1. Immediate Response from Police Scotland – Ensuring they provide all requested documents, evidence, and explanations regarding the unlawful search, detention and kidnapping.
  2. Government Oversight into Violations of Diplomatic Protections – A full investigation into Police Scotland’s breach of the Vienna Convention on Diplomatic Relations and the Diplomatic Privileges Act 1964.
  3. Accountability for the Unlawful Actions – Disciplinary or legal proceedings against those responsible for these violations.
  4. Restitution and Compensation – Immediate arrangements to return unlawfully seized property and compensate for damages.
  5. Prevention of Future Violations – Establishing measures to prevent further infringements of CLC Diplomatic rights and protections.

This is a matter of both domestic and international significance, and failure to act would set a dangerous precedent for the respect of diplomatic immunity and the rule of law in the United Kingdom. Given the prior lack of response, we request that you acknowledge receipt of this

letter and confirm what actions will be taken within seven (7) days from the receipt of this correspondence.

In conclusion, the international implications of this matter cannot be overstated, particularly in light of the UK’s position in the current geopolitical landscape. We trust that you will consider this matter with the seriousness it warrants and take the necessary steps to ensure full compliance with these established diplomatic conventions.

You will obviously be aware that your involvement in this matter will also be of great international significance, given the role that you currently play in the Russian and Ukrainian conflict. 

We trust that you will address this matter with the seriousness it demands and look forward to your prompt response.
